The 341 Meeting / Meeting of CreditorsThis meeting is at the Federal courthouse in Hammond, Indiana. DressPlease make sure that you wear professional dress at the meeting. It does not have to be your Sunday best, but should not be your work clothes. If you have a sport coat or dress slacks, you might as well wear them to the meeting. Please remember that even though you are not appearing before a Judge, this is a formal judicial proceeding. Documents Needed at the MeetingYour attorney will have already sent all of the documents you signed to the Trustee. Normally, you only have to bring the following documents to the hearing: - Your driver's license, state identification card, or other picture identification card issued by a government agency.
- Your social security card or W-2 with your full Social Security number on it. Please note: You cannot use your driver's license to prove your Social Security number.
Questions Asked at the MeetingThe Chapter 7 Trustee will have you take an oath and then ask you to sit by your attorney to answer some standard questions. Please remember that you are testifying under oath, so make sure your answers are audible, truthful, and complete.
In a basic consumer Chapter 7 bankruptcy, the Trustee examination usually takes around 15 minutes. Listed below are some sample questions the Trustee will ask you. Please note that this list is not exhaustive.
- What is your name? Where do you reside? How long have you lived there? Have you lived in Indiana for the greater portion of the last 180 days?
- Have you ever filed bankruptcy before?
- Did you receive and read the Bankruptcy Information Sheet?
- Do you own or are you purchasing any real estate? If so, what is the value of the real estate. What is that value based on (real estate appraisal or tax assessment)?
- Do you have to pay domestic support obligations (alimony or child support)? If so, to whom? Are you current on the support?
- Does anyone owe you any money? Do you have the right to sue anyone? Are you entitled to receive any life insurance proceeds or inheritance as a result of someone's death?
- Did you file a tax return last year? Did you receive a refund? If so, how much?
- When you visited your attorney, did you have them draft up bankruptcy papers for you? Did you review the papers before you signed them? Are they accurate and complete? Do they list all of your assets? Do they list all of your creditors?
